Draft Perdamaian Prita-Omni

VIVAnews - Departemen Kesehatan menawarkan mediasi untuk mendamaikan Prita Mulyasari dan Rumah Sakit Internasional Omni Alam Sutera. Namun, hingga kini perdamaian atas kasus pencemaran nama baik yang dilakukan Prita terhadap RS Omni itu belum menemui titik temu.

“Jika draf perjanjian ini ditandatangani, kami sepakat perkara perdata dicabut dan membebaskan Prita dari ganti rugi yang dibutuhkan. Tapi dari pihak kuasa hukum Prita meminta pidana dicabut. Masalahnya ini kan bukan kewenangan kami,” kata kuasa hukum RS Omni, Risma Situmorang.

Penghentian kasus pidana, kata Risma, adalah kewenangan penegak hukum. Sesuai pasal 75 KUHP, pelapor bisa mencabut aduannya maksimal 3 bulan. “Sedangkan kasus ini sudah dari Agustus 2008,” kata Risma.

Berikut draf perdamaian yang disampaikan kuasa hukum RS Omni dalam jumpa pers di kantornya, Jalan Antara No 45A, Jakarta Pusat, Rabu 9 Desember 2009. Pihak pertama adalah Prita, dan pihak kedua adalah RS Omni.

1. Kedua pihak sepakat bahwa segala permasalahan antara pihak pertama dengan pihak kedua yang terjadi sebagai akibat dari peristiwa di atas dianggap telah selesai dengan saling memaafkan dan saling menghargai. Oleh karena itu tidak akan melanjutkan, baik pada saat ini maupun di masa mendatang.

2. Kedua pihak sepakat bahwa kedua pihak mencabut perkara perdata yang sudah dicatatkan di pengadilan atau sedang berjalan prosesnya di pengadilan.

3. Kedua pihak sepakat untuk menyerahkan perjanjian perdamaian ini kepada pengadilan untuk digunakan sebagai pertimbangan dalam perkara pidana yang sedang berjalan berproses sesuai dengan peraturan perundang-undangan yang berlaku.

4. Kedua pihak sepakat untuk tidak mengajukan keluhan, pengaduan, gugatan ataupun penuntutan baru, dalam bentuk apapun, baik melalui instansi penegak hukum, penasehat hukum, maupun media massa baik cetak maupun elektronik.

Follow these easy steps to restore the damaged/corrupted or missing hal.dll file from the Windows XP CD using the Recovery Console.
Difficulty: Easy
Time Required: Restoring hal.dll from the Windows XP CD usually takes less than 15 minutes
Here’s How:

Enter Windows XP Recovery Console.

When you reach the command line prompt (detailed in Step 6 in the link above), type the following and then press Enter:
expand d:\i386\hal.dl_ c:\windows\system32\hal.dll

Using the expand command as shown above, d represents the drive letter assigned to the optical drive that your Windows XP CD is currently in. While this is most often d, your system could assign a different letter. Also, c:\windows represents the drive and folder that Windows XP is currently installed on. Again, this is most often the case but your system could be different.

If you’re prompted to overwrite the file, press Y.

Take out the Windows XP CD, type exit and then press Enter to restart your PC.

Assuming that a missing or corrupt hal.dll file was your only issue, Windows XP should now start normally.
Tips:

If you suspect that the hal.dll file is not being expanded properly in Step 2 above, try dropping hal.dll from the end of the command so the exact command would look like this:
expand d:\i386\hal.dl_ c:\windows\system32\
